THE PROCESS OF PROBATE
If the deceased has a will
If the decedent left a Will, the court will look into its validity. The estate is then distributed in accordance with the directives given in the Will after paying all the debts of the decedent. The person who administers the estate under the terms of the Will is usually the person who is the named executor in the Will. If the Will does not specify an executor or the person named in the Will is not willing or unable to serve in that capacity, the court will appoint someone else to administer the estate.
If the deceased didn’t have a Will
If the decedent died without leaving a Will, the property is divided among the decedent’s heirs. In California, the property first goes to the spouse or children. If the decedent did not leave behind a spouse or children, the property goes to the person’s next nearest relatives. In such cases, the court will appoint an administrator to manage and distribute the assets. This person is known as the administrator.
